Two Senators Propose Supreme Court Term Limits

The legislators introduced a resolution to implement 18-year term limits for justices.

Senators Joe Manchin of West Virginia and Peter Welch of Vermont introduced a resolution that would impose 18-year term limits on Supreme Court justices. If implemented, it would maintain nine total justices while ensuring the rotation of one justice in the high court every two years.

“The current lifetime appointment structure is broken and fuels polarizing confirmation battles and political posturing that has eroded public confidence in the highest court in our land,” stated Senator Manchin, who is retiring at the end of the year.

“Setting term limits for Supreme Court Justices will cut down on political gamesmanship, and is commonsense reform supported by a majority of Americans,” stated Senator Welch, a member of the Senate Judiciary Committee.

Currently, Supreme Court justices are allowed to serve for as long as they choose or until they are incapacitated. The most recent Supreme Court justice to step down was Stephen Breyer, who retired in 2022 at the age of 84.
